Qatar's Income Tax Law requires every taxpayer, even one benefiting from a tax exemption, to file a tax return with the General Tax Authority. The executive regulations set the standard filing deadline at four months from the end of the tax year, with a special 30-day deadline for the capital gains return, and the possibility of requesting an extension of up to an additional 4 months.
The Duty to File Even When Exempt
The law provides that the taxpayer must submit a return to the Authority, on the form prepared for this purpose, stating the taxable income and the amount of tax due, even if the taxpayer benefits from a tax exemption. With the Authority's approval, the taxpayer may submit an amended return to correct errors contained in a return for a prior year or to add anything omitted from it.
The General Deadline: 4 Months From the End of the Tax Year
The executive regulations provide that the tax return is filed by the resident taxpayer and by the non-resident taxpayer carrying out an activity through a permanent establishment in the state within 4 months of the end of the tax year, on the form prepared by the Authority for this purpose. If the taxpayer's accounting period differs from the tax year, the return for that accounting period is filed within 4 months of the end of that period.
Capital Gains: a Separate 30-Day Return
The law provides that the tax return for capital gains is filed on a separate form prepared by the Authority, within 30 days of the date the contract is concluded or the disposal of the assets takes place, whichever is earlier.
Special Cases: Death and Legal Incapacity
If the taxpayer dies, the heirs or the liquidator must file the tax return within 6 months of the date of death. If the taxpayer is a minor or legally incapacitated, the guardian, custodian, or trustee files the tax return within 4 months of the end of the tax year.
Possible Extension: Up to an Additional 4 Months
The Authority may extend the deadline for filing the tax return for a period not exceeding 4 months from the original deadline, if the taxpayer submits a request based on acceptable grounds at least 60 days before the original deadline. Failure by the Authority to respond to an extension request within 30 days of its submission is deemed an implicit rejection.
